Terms & Conditions
Last updated: June 2026
1. Who you are contracting with
The Xirtam product and website ("Service") are provided by Eran Kolran("Seller", "we", "us"). By using the Service you agree to these Terms & Conditions ("Terms") and form a binding contract with the Seller.
2. Acceptance
By accessing the website, creating an account, or using the Service, you confirm that you accept these Terms and that you have authority to do so on behalf of any organisation you represent. If you do not accept these Terms, do not use the Service.
3. The Service
Xirtam is a custom right-to-left matrix visual for Microsoft Power BI. We provide the Service on a continuing basis but do not guarantee that it will be uninterrupted, timely, or error-free.
4. Acceptable use
You must not, and must not allow any third party to:
- Use the Service unlawfully or for fraudulent, deceptive, or harmful purposes;
- Send spam, malware, or interfere with the security or integrity of the Service;
- Probe, scan, or scrape the Service or attempt to bypass technical limits;
- Infringe any intellectual property, privacy, or other rights;
- Reverse engineer, decompile, or attempt to extract source code, except where law expressly permits;
- Resell, sublicense, or redistribute the Service without our written permission.
5. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.
6. Intellectual property
The Service, including all software, documentation, designs, and branding, is owned by the Seller and protected by intellectual property laws. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable right to use the Service.
7. Payments, subscriptions, taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com (Paddle.com Market Ltd) is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By purchasing, you also agree to Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms, which govern payment, billing, taxes, renewals, cancellations, and refunds for your order.
8. Refunds
See our Refund Policy for details on how to request a refund.
9. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time.
10. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. To the extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid for the Service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g. fraud, death, or personal injury caused by negligence).
11. Indemnity
You agree to indemnify and hold the Seller harmless from claims arising from your unlawful use of the Service, your content, or your breach of these Terms.
12. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after the changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Seller's place of residence, without regard to its conflict-of-laws principles. The courts of that jurisdiction have exclusive jurisdiction over any disputes, subject to any mandatory consumer protection laws that apply to you.
14. Contact
Questions about these Terms can be directed to Eran Kolran via the contact options on this website.
